Martha Karua is remembered for her efforts during the fight for multiparty. She was the minister for Justice during the time of President Mwai Kibaki. Martha Karua was allegedly instigated the arrest and malicious prosecution of Justice Kariuki. According to documents filed in a civil suit at High Court, this happened after he walked out on her. He was sued by the Attorney General for attempted murder. However, the case was dropped due to lack of evidence.

Justice Kariuki took the State to court so that he can be compensated for the wrongful arrest and detention. According to the Judge who heard his Kariuki's case, Kariuki was wrongfully arrested ‘commando style’ and publicly humiliated on October 20, 2008.
According to investigating officers, the court was told that they were under pressure from the Attorney General and the Justice minister. "...The police admitted that the charge of attempted murder was a hoax and this was confirmed by the findings of the trial court.”

The Judge ruled that Kariuki was publicly humiliated. "The Nairobi Area Criminal Investigation Officer wrongfully caused the plaintiff to be publicly humiliated...hence the defendant is liable to pay damages of Sh5,000,000.00 for general damages for malicious prosecution is reasonable compensation in the circumstances and I award the same.” read the judge sheet.
